As used in this Warranty, "We,""Our" and "Us" refers to YesAsia.com Ltd., or the company to which YesAsia.com Ltd. may delegate or assign its obligations hereunder, and "You" or "Your" refers to the original purchaser of the product specified in this Warranty.
WHAT IS COVEREDWe will furnish labor and parts necessary to repair mechanical breakdowns of the product specified above (the "Product"). If We determine, in Our sole discretion, that repair of the Product is impractical, We will either attempt to replace the Product with a similar item that, in Our sole discretion, is of comparable value and functionality, or will reimburse You for the purchase price You paid to Us for the Product. Coverage under this Warranty is limited to product failure occurring during normal usage of the Product as originally configured and unmodified. In the event We repair the Product, replace the Product with another item of comparable value and functionality or reimburse You for the original purchase price of this Product, We shall have satisfied all of Our obligations hereunder.
Coverage under this Warranty will apply only if the Product is returned to us pursuant to the instructions below and received by Us on or prior to the Warranty End Date specified above. No coverage will be provided for repairs made by any facility other than those contracted by us directly. To make a claim under this Warranty, please notify our customer services department to obtain a Return Merchandise Authorisation number (RMA), and be prepared to provide the Product details and other information set forth at the top of this Warranty. Upon receiving an RMA, You will be required to ship the Product back to Us at Your expense. Upon our receipt and inspection of the Product, and confirmation that the Product is defective and covered by this Warranty, We will provide to You merchandise credits to purchase items on Our website in the amount of the postage paid by You for return shipping of the Product. If we determine that the Product is not damaged or defective, or that any damage or defect is not covered by this Warranty for any reason, We will not provide You with such credits, and You will be required to pay us in advance for the cost of shipping the Product back to You.
THIS WARRANTY DOES NOT COVER- Installation, removal, or reinstallation of any Product or component thereof.
- Damage or other Product failure due to causes beyond Our control including, but not limited to, power failure, power surge or inadequate power supply, operator negligence, failure to maintain the Product according to instructions provided with the Product, abuse, vandalism, computer viruses, theft, fire, flood, wind, freezing, unusual atmospheric conditions, telephone failure, or acts of war or acts of God.
- Batteries, bulbs, toner, ink and other consumables.
- Loss or damage to recording media, software or data.
- Damage resulting from commercial use.
- Products with removed or altered serial numbers.
- Cleaning or other preventative maintenance.
CLAIMS LIMIT
Our total liability for all claims under this Warranty shall not exceed the original price paid by You to Us for the Product (not including shipping and handling costs and taxes). This Warranty may be assigned by Us without consent or notice to You. You may not assign this Warranty, and our obligations hereunder will not apply to any subsequent owner of the Product. [Out of Warranty Program ¡V We will cover maintenance of item within the warranty period and during the warranty period we will also cover three times two way shipping postage fees.] This Warranty shall be governed by the laws of Hong Kong, and the parties hereto irrevocably consent to the exclusive jurisdiction of the courts of Hong Kong to resolve any disputes arising in connection with this Warranty.
CANCELLATION AND REFUND
You may cancel this contract at any time for any reason.
If You cancel this Contract by providing written notice to our Customer Services Department at the address below within thirty (30) days of the date the Product was purchased You will receive a refund of the amount paid for the Warranty, less any amounts incurred by Us with respect to any claims made by you hereunder.
If You cancel this Contract following such thirty (30) day period, You will be refunded a portion of the amount paid for the Warranty, calculated based on the remaining days of coverage on a monthly prorated basis less any amounts incurred by Us with respect to any claims made by you hereunder.
